The Supreme Court has reserved judgment on the appeal against Nasarawa State Governor Abdullahi Sule’s election.
The legal battle pits Governor Sule of the All Progressives Congress (APC) against the Peoples Democratic Party (PDP) and its governorship candidate in the 2023 election, Hon Emmanuel David Ombugadu.
During the appeal hearing, Kanu Agabi, SAN, the lead counsel for the PDP and its governorship candidate, urged the Supreme Court to overturn the Court of Appeal’s November 23 decision, which confirmed Sule as the duly elected governor.
Agabi urged the Supreme Court to reinstate the October 2, 2023 judgement of the Nasarawa State Governorship Election Petitions Tribunal, which favoured the PDP and Ombugadu.
Agabi contended that the Court of Appeal unjustly nullified the Tribunal’s judgement and improperly declared Sule as the winner of the March 18 gubernatorial election.
He specifically requested that the Supreme Court recognise the votes of Nasarawa State residents, declaring the PDP and Ombugadu as winners in accordance with the Tribunal’s decision.
The APC’s legal team, led by Akin Olujinmi, SAN, urged the Supreme Court to carefully review the authorities cited in support of their request for the case to be dismissed.
Following the arguments, Justice Kudirat Kekere-Ekun announced that the judgement had been reserved, and that the date of delivery would be communicated to all parties involved.
In a previous ruling on November 23, the Appeal Court overturned the State Election Petitions Tribunal’s decision on October 2, which had previously declared Gov Sule’s election null and void.
